DEFINITIONS
"Dolar Maker" refers to the online e-business (www.dolarmaker.com) of Modern Solution Sdn Bhd, which sells products to the Customer as identified in Dolar Maker's quotation or invoice.

"Customer" means the person or legal entity identified in Dolar Maker's quotation or invoice.

"Contract" means a contract for sale by Dolar Maker to the Customer of the products and/or services incorporating the Terms and Conditions

Legal Disclaimer
This disclaimer includes any representations or warranties regarding issues or compliance and Dolar Maker assumes no liability regarding any of the products or services sold by us. Representations and warranties, if any, may be available directly from the manufacturer or publisher of certain products. This disclaimer in no way affects the term of the manufacturer's warranty. The title to purchased goods is retained by Dolar Maker until goods are paid for by the purchaser.

Dolar Maker provides this site and its contents on an "AS IS" basis and makes no warranty or representation, either express or implied, including the warranties of merchantability, fitness for a particular purpose, and non-infringement.

Product Pricing and Availability
Prices, specifications and availability of products are subject to change without any notice. Due to the dynamic nature of the computer industry, descriptions may not reflect current technical information. Any typographical or photographic errors in the product specifications or errors in the pricing or offers is subject to correction. If a product is not currently available due to unforeseen circumstances or reasons, we will keep you posted on the next delivery date.

Order Acceptance Policy
Your order confirmation is not a contract, it is a record of your offer to purchase a particular item at a particular price. Once you have placed your order, DolarMaker will decide whether or not to fulfil the order, and Dolar Maker may refuse to fill an order for any reasons. We may require additional verification or information before accepting any order.

We reserve the right to cancel an order even if payment for your order has been received. A full refund will be made in the event of any cancelled order.

Typographical Errors
In the event a product is incorrectly priced or if there are errors in the specifications, whether due to typographical errors, or errors on the part of our vendors, Dolar Maker reserves the right to refuse or cancel any order placed for such products. If the order has been processed and payment has been approved, Dolar Maker shall issue a reversal on the charge issued to the credit card or any other transaction system which is agreed upon and approved by both parties .

SOFTWARE
All software provided is subject to the terms and conditions of the license agreement relating to that software. The Customer acknowledges his or her obligations to abide by such license agreements. The Customer acknowledges that Dolar Maker does not warrant any software under these Terms and Conditions. All software is warranted in accordance with the license agreement that governs its use.

All rights, title or interest in respect of the intellectual property rights in the software remain with Dolar Maker or the licensor of the software at all times.

TITLE AND RISK
Title to and risk in the products shall pass to the Customer upon delivery of the products to the Customer. Title to software products shall remain with the applicable licensor(s) at all times.

Delivery
Any delivery date provided by Dolar Maker shall be indicative only and shall not be an obligation on Dolar Maker. Customer acknowledges that in purchasing products it has not relied on any representation by Dolar Maker as to the delivery date of products.

Dolar Maker shall deliver the products to the place of delivery designated by the Customer and agreed to by Dolar Maker ("Place of Delivery").

Any dates quoted by Dolar Maker for the delivery of the products are approximate only and shall not form part of the Contract. Dolar Maker shall not be liable for any delay in the delivery of the products and/or services.,

Product Acceptance
Unless Customer notifies Dolar Maker to the contrary by the day after the delivery of Products, Products shall be deemed to have been accepted by the Customer in a good condition and in accordance with the Agreement.

In the event a product is incorrectly priced or if there are errors in the specifications, whether due to typographical errors, or errors on the part of our vendors, Dolar Maker reserves the right to refuse or cancel any order placed for such products. If the order has been processed and payment has been approved, Dolar Maker shall immediately issue a credit note on the charge issued or a similar replacement item will be send subject to availability to the customer .

Warranty and Repairs
This Warranty does not cover damage, fault, failure or malfunction due to external causes, including accidents, abuse, misuse, problems with electrical power, unauthorised servicing, usage and/or storage and/or installation not in accordance with product instructions, failure to perform required preventive maintenance, normal wear and tear, act of God, fire, flood, war, act of violence or any similar occurrence; any attempt by any person other than Dolar Maker personnel or any person authorised by Dolar Maker, to adjust, repair or support the products and problems caused by use of parts and components not supplied by Dolar Maker. The Warranty does not cover any items that are in one or more of the following categories: software; external devices; accessories or parts added to the product after the product is shipped from Dolar Maker .

Unless specified otherwise during the one-year period beginning on the invoice date, Dolar Maker will repair or replace products returned to Dolar Maker. The Customer must prepay shipping and transportation charges, and insure the shipment or accept the risk of loss or damage during such shipment and transportation. Dolar Maker will ship the repaired or replacement products to the Customer with freight prepaid.

Dolar Maker does not give any warranty that the products are fit for any particular purpose and this Standard Warranty is given in place of all warranties, conditions, terms, undertakings and obligations implied by statute, common law, trade usage, course of dealing or otherwise including warranties or conditions of merchantability, fitness for purpose, satisfactory quality and/or compliance with description, all of which are hereby excluded to the fullest extent permitted by law.

The Customer agrees that, in relation to third party products purchased through Dolar Maker, where the products are covered by a relevant manufacturer's warranty, then the Warranty shall not extend to such products and such manufacturer's warranty shall be the sole warranty in respect of such products. The Customer shall utilise that warranty for the support of such products and in any event not look to Dolar Maker for such warranty support.

During the carry-in warranty period, where applicable, Dolar Maker shall repair or replace products shipped to Dolar Maker's facility. Such products shall be shipped with freight prepaid to Dolar Maker in their original or equivalent packaging with the Return Material Authorisation Number ("RMAN") clearly marked thereon.The Customer shall bear the risk of loss or damage during such shipment.

Dolar Maker is not obliged to accept any returned product for warranty service without a RMAN issued by the company. A RMAN shall be issued by Dolar Maker to the Customer upon request for warranty service.Customers are responsible for products until Dolar Maker receives them. Returned products must be in the samecondition as when received by the Customer.

The Customer acknowledges that Dolar Maker shall not be liable for any loss of data or software and that Dolar Maker is under no obligation to advise or remind the Customer on appropriate back-up procedures.

Support Services
During the warranty period Dolar Maker shall provide at no charge to the Customer support services for products by telephone, facsimile or email. Beyond the warranty period, such services shall be charged at the then prevailing rates in Dolar Maker's price list.

Limitation of Liability
In no event shall Dolar Maker be liable for any direct, consequential, indirect, incidental or special damages whatsoever, including without limitation, damages for loss of business profits, business interruption, loss of business information, and the like, arising out of the use of or inability to use products, even if Dolar Maker has been advised of the possibility of such damages.

Force Majeure
Neither party shall be liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of the party so delaying, and such party shall be entitled to a reasonable extension of time for the performance of such obligations.

Export Restriction
The Customer acknowledges that products licensed or sold under the Agreement may be subject to the export control laws of certain countries. The Customer confirms that with respect to products, it will not export or re-export them, directly or indirectly, either to

( a ) any country which is subject to any export restriction imposed by any other country or

( b ) any end-user who has been prohibited from participating in export transactions by any agency of any government.

The Customer also confirms that products will not be sold or licensed to an end-user whom the Customer knows or has reason to know will utilise products directly or indirectly in nuclear activities, whether the items are specifically designed or modified for such activities. The Customer further states that products will not be destined for or used in the design, development, production or use of missiles or missile projects. The Customer further acknowledges that products may include technical data subject to export and re-export restrictions imposed by certain countries.
